AG seeks High Court orders to refer four questions to Supreme Court for interpretation  

The Attorney General has prayed the High Court to refer four statements of questions to the Supreme Court for interpretation.   The notice of prayer for referral of stated questions is in relation to Article 130 (1) (a) and (2) of the 1992 Constitution.   In an application dubbed the Republic verses Attorney General, Ex-Parte Gertrude Araba Esaaba Sackey Torkornoo's, the AG is asking, “Whether a person may retain his or her previous judicial office, if any, upon appointment to the Office of the Chief Justice.   Secondly, “whether the Chief Justice’s membership of the Superior Courts of Judicature is ex officio the Office of the Chief Justice.”   Thirdly, the AG is demanding, “Whether a person may retain his or her membership of the Superior Courts ...

President Mahama Removes Chief Justice Gertrude Torkonoo from Office

President John Dramani Mahama has removed the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkonoo, from office with immediate effect. The decision, according to a statement signed by Felix Kwakye Ofosu, Spokesperson to the President and Minister for Government Communications, was taken in accordance with Article 146(9) of the 1992 Constitution. It follows the submission of a report by a committee constituted under Article 146(6) of the Constitution to investigate a petition brought forward by a Ghanaian citizen, Mr. Daniel Ofori. President Mahama Suspends Chief Justice, Sets Up Committee to Probe Petitions

President John Dramani Mahama has suspended Chief Justice Gertrude Araba Esaaba Sackey Torkornoo following the establishment of a prima facie case against her. The decision comes after three separate petitions were filed and reviewed in accordance with Article 146(6) of the 1992 Constitution and in consultation with the Council of State. A five-member committee has been constituted by the President to investigate the allegations.
