Akosua Serwaah Appeals High Court Ruling Over Daddy Lumba Marriage Certificate

Akosua Serwaah Fosuh, one of the wives of the late highlife legend Daddy Lumba, has filed an appeal against a ruling by the Kumasi High Court which held that the marriage certificate she presented was not admissible in evidence.

Dissatisfied with the decision, Madam Serwaah is asking the Court of Appeal to set aside the ruling delivered by Her Ladyship Justice Dorinda Smith Arthur on November 28, 2025.

In a notice of appeal sighted by 3news, the appellant stated that she is aggrieved by the judgment of the High Court and is seeking a reversal of the decision. Her legal team challenged the court’s findings, arguing that the trial judge erred in law by declaring the marriage certificate — marked as exhibits “B”, “B1” and “B2” — inadmissible.

According to the appeal, the High Court also erred in its interpretation of Section 161 of the Evidence Act, holding it as a condition precedent for placing weight on an admitted document. Additionally, the appellant contends that the court wrongly concluded that the evidence presented by the defendants was more credible than hers.

Based on these grounds, Madam Serwaah is seeking an order from the Court of Appeal to set aside the entire judgment of the High Court and enter judgment in her favour.

The defendants in the case include Abusuapanin Kofi Owusu of Abuakwa-Kumasi, Priscilla Ofori, also known as Odo Broni of Accra, and Transitions Funeral Home, also known as Enterprise Funeral Services, based in Haatso, Accra.
